(It is the changing the file size etc to get it on OM that is the hard part)!!

I know I bore everyone to death by bringing this up every time the gallery is mentioned, but... The T&Cs still haven't been changed regarding the upload of photos to the site, despite Jon saying (last summer, I think) that they would be changed, especially after I pointed out how DCMag website had added an extra 'Section 3.1' to their otherwise identical T&Cs, which basically said 'we won't sell your photos etc. without asking you first'. Section 3.1 of DCMag's T&Cs here - a simple addition which made everyone happy.

 As far as I'm aware, Neville's last post on the subject was on 8 March '06 on this thread.I assumed it would be done, I think you're quite right to flag it up if it still hasn't been changed Michael.

 Michael, you're not boring at all. Like you, we sell our images and they are copyrighted to us which is why, like you, we haven't uploaded anything since you brought up this problem.

Cheers for that link Mistress - OK, so it was November when Jon said the T&Cs would be changed, and March when Neville confirmed it would be done "next week".
I'm sure, like Jon has said in the past, that OM do not intend to go licensing out member images, and that the T&Cs are just there to cover their backs. BUT, these kind of terms are not good (for us), and they're cropping up everywhere, eroding the rights of photographers and the like. And while OM might not try and flog off some of the cracking photos that get uploaded, there will be other sites with identical T&Cs that do. As such, I haven't uploaded any images to OM since I first noticed the T&Cs and deleted my gallery.
I would like to upload photos. And I know at least a couple of people have asked to see my images recently (so I provided links to where they can be found elsewhere). And I know JJs got some fantastic images that won't be seen in the OM gallery.
Seems a shame, when a 'Section 3.1' seems so simple an addition, and doesn't harm anyone's interests... and was promised many months ago...
Anyway, I'm off to print off JJ's testimony (I'm not boring!) in size 200 bold, red font.

Thanks for raising this.
I've read this thread and am surprised to find it has not ended with an apology for the delay and a clarifying statement from OM of it's position, to your satisfaction or otherwise.
I have never uploaded photos to the site but this kind of issue is an indicator about the character and trustworthiness of a website.
I've reported your comment to the administrator (in case this forum is not monitored regularly) asking "What's OM's answer to this?"

 I doubt we'll get a resolve to this during the weekend. We have to remember that Jon and the crew do OM for a job, so probably don't check here at all on their "day off".

As regards anything entered for competitions such as photo competitions:
Terms & Conditions para 9(c): "(you) acknowledge that Magicalia may use such creative material in any way it sees fit without further payment to you"
Pretty unambiguous. There are other clauses in para 9 that say pretty much the same thing in different ways as legal docs do.

 But Neil, all THAT says is, "I promise that all my photos are mine and I didn't copy them from Andy Wallace or whoever". It doesn't protect the photographer at all.
What about: "Any Content provided by you by, for example...uploading files...although owned by you, is subject to a royalty-free, perpetual, non-exclusive, unrestricted, world-wide licence allowing Magicalia to use, distribute, copy, sub-license, adapt, transmit, publicly perform or display any such content. You agree to irrevocably and unconditionally waive on your behalf in perpetuity in respect of such Content the benefit of any provision of law known as moral rights of authors or any similar law in any country."

 JJ - that says files, further down it actually mentions photo's on the gallery, well i am presuming it means the gallery on here as well, under ...

Where it only says this (notice the part i have put in capitals):

I cannot find anything else about submitted photo's.
However if we are considering the photo's in the OM gallery as just 'files' then you all have a case.
Maybe someone can clarify this situation???
